PLEASE NOTE that while travelling to, engaging within and travelling from a challenge - your safety and that of anyone with you - is entirely your own responsibility.   

​

Locations during the treasure hunt will never be in unauthorised locations and you will not need to undertake any unusual physical activity.  

​

Please respect all other players, the general public and business owners; treating others as you would wish to be treat. 

​

The rule of law, including all and any local by-laws and that of established common sense shall prevail.  GeoCash Ltd or any of its representatives cannot and will not be held responsible for your behaviour, choices or that of anyone else.

Terms & Conditions

GeoCash Limited is a company incorporated in the United Kingdom with Company number 13875469 and its registered office at Carlbury Hall House, Piercebridge, Darlington, England, DL2 3TP (“GeoCash”). 

These terms and conditions (“Terms and Conditions”) set out the rules and conditions for use of the GeoCash Application. By downloading, accessing and/or using the Application, each User of the Application, whether they are a registered or unregistered User, is deemed to have read, accepted and agreed to be bound by these Terms and Conditions and the GeoCash Privacy Policy as incorporated by reference herein.

Please note, the GeoCash Application is directed at people residing in the United Kingdom. GeoCash does not represent or warrant that the content available through our Application is appropriate for use in, or available in, other locations. Consequently, this policy is based on, and governed by, the laws in the United Kingdom only.

1. Definitions and Interpretation

“Application” means any of the online, mobile based applications or platforms of the Supplier;

“App Store” the Apple App Store, Google Play or such other repository of mobile applications made available for download as may be compatible with the Application from time to time;

“Personal Data” has the meaning ascribed to it in the Data Protection Act 2018;

“Supplier” means GeoCash, its successors and assigns or any person acting on behalf of and with the authority of GeoCash;

“Treasure Hunt” means any treasure hunt or any other type of game, challenge or competition provided via the Application. 

“User” means the person using the Application (or any person acting on behalf of and with the authority of such person);

 

2. Grant of License

  1. In consideration of downloading, and registering on, the Application, the Supplier grants to each User a limited, non-exclusive, non-transferrable, revocable license to use the Application for non-commercial purposes strictly in accordance with these Terms and Conditions.         
     

  2. Users must not:

    1. use the Application in any way that could damage the reputation of the Supplier or the goodwill or other rights associated with the Application;

    2. permit any third party to obtain the Application other than by download through an App Store;

    3. reproduce, make corrections or otherwise modify the Application;

    4. de-compile, disassemble or otherwise reverse engineer the Application or attempt to extract the source code of the software associated with the Application or permit any third party to do so except as may be permitted by law;

    5. modify or remove any copyright or proprietary notices on the Application;

    6. use any spider, scraper, robot or other means to access, display, or collect data from the services/Application without the Supplier’s express written consent;

    7. publish any hints, spoilers, solutions, or the location(s) of any clues on our website, any social media platforms or anywhere else; and/or

    8. use apps, devices, programs, or any other means to misrepresent your/your device’s location for any purpose whilst participating in a Treasure Hunt

3. Participation

  1. At the time of using the Application, and to participate in a Treasure Hunt, Users must be:

    1. eighteen years of age or older; and

    2. residing in the United Kingdom. 

 

  1. Users must create an account and provide certain information about themselves in order to participate in a Treasure Hunt and/or use many of the features of the Application. Users are solely responsible keeping their account details, including their account password confidential and will not share their account details with any third party or let anyone else use their account or access their account details. Account information will be treated in accordance with the Supplier’s Privacy Policy .

 

  1. The User understands and agrees that they are fully responsible and liable for any illegal or improper conduct during his/her use of the Application and/or during his/her participation in any Treasure Hunt. The Supplier does not control nor endorse improper conduct by any User. The Supplier expressly denies and disclaims any liability towards any User or any third party and denies any obligation to indemnify any User or any third party for any losses which a User/third party may incur as a result of a User’s behavior during and/or after such User’s use of the Application and/or participation in a Treasure Hunt. 

 

  1. Users acknowledge, accept and assume all risks, responsibilities and costs associated with participating in a Treasure Hunt, and any other location-based activities associated with/provided by the Application. Whilst Users’ safety is of paramount importance to the Supplier, Users understand that participating in location-based activities, such as a Treasure Hunt, can be inherently dangerous and may involve travelling to/accessing difficult to access or potentially treacherous locations. When taking part in such location-based activities, Users understand that there is a risk of property damage, bodily injury, or death. Users must consider variables such as the User’s fitness level, terrain features, and the weather. It is the User’s responsibility to ensure that they are suitably prepared and equipped to participate in the relevant Treasure Hunt and to check the current conditions before going outdoors. Ultimately, it is the User’s sole decision whether to participate in a Treasure Hunt and/or to access certain locations, as well as their method of travel to such locations; the Supplier shall not be responsible or liable for any losses suffered by a User as a result of the User’s participation in a Treasure Hunt or use of the Application, except as set out in clause 10. The Supplier does not warrant or guarantee that any location accessed by a User (whether suggested as a clue location/place to go by the Application or not) is safe or legal. 

 

  1. Users must not enter third parties’ property without permission and must always obey applicable laws when using the Application/participating in a Treasure Hunt. Presence of certain information within the Application (e.g. the location of a clue) does not imply that accessing such location is safe or legal.        
     

  2. The Supplier reserves the right at its absolute discretion to cancel or stop a Treasure Hunt at any point in time for any reason without liability, including but not limited to if it suspects any cheating, dishonest conduct or a hacking attempt or manipulation attempt by any User and/or third party.    
     

  3. The Supplier reserves the right at its absolute discretion to remove or block any User from accessing or using the Application, or to disqualify any User from participating in a Treasure Hunt, for any reason, including but not limited to, if a User fails to comply with these Terms and Conditions (or the Supplier believes a User might be in breach of any term of these Terms and Conditions).  

 

  1. Treasure Hunt Rules

 

  1. The ultimate aim of each Treasure Hunt is to be the first User to complete the Treasure Hunt and find the final clue. 

 

  1. As Users find and correctly identify and log clues within the Application, the next clue will be unlocked and revealed within the Application until the User unlocks and finds the final clue and finishes the Treasure Hunt. 

 

  1. Users are only entitled to one guess per clue. If a User gets the clue incorrect, they will be automatically disqualified from the Treasure Hunt (unless the Application/rules of the Treasure Hunt permits otherwise – for example, if the User has purchased an additional guess for a clue). 

 

  1. The winning user (“Winner”) will be the User who: (i) is the first User to complete the Treasure Hunt and find the final clue (which is confirmed as the correct final clue by the Application); (ii) correctly identifies and logs the final clue on the Application as per the instructions; and (iii) complies with these Terms and Conditions and any applicable instructions within the Application, and in particular satisfies the criteria at clause 3(a) of these Terms and Conditions.

 

  1. If applicable, the prize for winning each Treasure Hunt will be notified to Users within the Application. Not all Treasure Hunts will award a prize to the Winner; the Supplier reserves the right at its discretion to decide whether a Treasure Hunt will have a prize for the Winner of that Treasure Hunt, which will be notified to Users in advance. 

 

  1. The Supplier does not accept any responsibility for Users failing to complete a Treasure Hunt/successfully logging any clues (including the final clue) due to a technical fault or error, nor does the Supplier accept any responsibility for the same due to a technical fault or error on the part of the User or the User’s failure to comply with, or adhere to, any applicable instructions and/or these Terms and Conditions.

 

  1. The Winner of each Treasure Hunt will be notified via the Application within 48 hours of them completing the relevant Treasure Hunt. Details of how to claim the prize for the Treasure Hunt (if applicable) will be provided to the Winner at the same time as receiving notification of them being the Winner. Each Winner will be required to provide proof of ID, age and UK residence when claiming their prize; in participating in the Treasure Hunt/using the Application, the User consents to provide such information to the Supplier. If a Winner fails to satisfy any identity/background checks (at the Supplier’s discretion) the prize will be withdrawn.                      
     

  2. If a Winner fails to claim their prize within 3 days of being notified that they are the Winner, or is otherwise disqualified or ineligible to participate in the Treasure Hunt, the prize will be withdrawn.

 

  1. The Supplier’s decision and confirmation of the Winner is final. 

 

  1. All prizes are final, non-transferable and not capable of exchange. Where a prize is anything other than cash (for example, a physical product or experience), there is no cash alternative and the prize shall not come with any warranty, promise, guarantee or otherwise by the Supplier. The Supplier reserves the right to award alternative prizes of equal or greater value should the advertised prize become unavailable for any reason.

 

  1. Winners agree to take part in any publicity that may arise as a result of them winning a Treasure Hunt and hereby permit the Supplier to use such publicity for the purposes of advertising the Application in any format/via any method. Confirmed Winners’ account names may be announced on social media platforms, on the Application, or otherwise published by the Supplier. By submitting their details on registration, Users agree to the Supplier using their personal data for the above purposes and fulfilment of prizes. Users consent to the Supplier using any text, photo or video content supplied as part of their registration or post-win publicity in future marketing activity for an indefinite period of time (until the Supplier is notified otherwise).    
     

  2. Users acknowledge and accept that events may occur that render the Treasure Hunt itself or the awarding of any prizes impossible due to reasons beyond the control of the Supplier and Users agree that no liability shall attach to the Supplier as a result thereof.

 

  1. Users must follow all of the instructions provided within the Application for each Treasure Hunt (as applicable to that Treasure Hunt). Failure to complete the instructions provided during the Treasure Hunt may result in the automatic disqualification from the Treasure Hunt and an automatic forfeiture of any claim to a prize. 
     

  2. Payment

 

  1. Users may undertake In-Application purchases at the User’s discretion as identified within the Application and these will be transacted at each time.  Payment processing will take place at that occasion, via the applicable App Store payment services.
     

  2. The User is responsible for all charges incurred in connection with their use of the Application/services. Users must provide a valid payment method. The User’s payment method will be processed by the App Store and any payment questions should be directed to the applicable App Store. 

 

  1. The applicable App Store’s terms and conditions and privacy policy from which the User makes the purchase, in addition to these Terms and Conditions will apply. In relation to the taking/processing of payments from a User, in the event of any inconsistency between these Terms and Conditions and the terms and conditions of the applicable App Store, the terms and conditions of the applicable App Store shall take precedence.             
     

  2. The Supplier may chose at its discretion how to distribute a prize to a Winner. Cash prizes may be given to the applicable Winner in person (e.g., via cash or cheque) or sent to the Winner’s bank account via a bank transfer. Where a prize is to be sent to via bank transfer, the Winner’s bank details will be requested and the Winner is solely responsible for ensuring that it has provided the correct bank details/information to the Supplier. Payment will be made directly, once the Winner, winnings and bank details have been verified and (with the exception of and allowance for any banking systems delays both national and international) will ordinarily be received by the Winner within 7 working days (but may be later).

 

  1. Termination

 

  1. The Supplier may immediately suspend or terminate (at its discretion) as User’s account (with or without notice) and block the User from the Application if the User does any of the following (or if the Supplier believes the User might have done, or may do, any of the following):

(i) the User breaches any term of these Terms and Conditions;

(ii) the User engages in fraudulent, illegal, defamatory, offensive activities or any activity in breach of the Supplier’s rights; or

  1. the User’s use of the Application adversely affects the operation of the Application/the Supplier’s services as determined by the Supplier in its sole discretion.

 

  1. Any suspension or termination of a User’s account applies to that User personally; Users cannot access the Application through any other account that they own or create or through accounts owned or created by others.       
     

  2. Users can stop using the Application and terminate their account at any time. All provisions of these Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.               
     

  3. If a User’s account/access to the Application is suspended or terminated by the Supplier or if the User un-installs the Application/terminates their account, the User will lose/forfeit any unclaimed prizes. 

7. Intellectual Property Rights

  1. For the purpose of this clause, “Intellectual Property Rights” means patents, copyright and related rights, trade marks, design rights database rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered, (excluding any content provided by a User) relevant to the Supplier and/or the Application, including but not limited to: 

    1. textual, audio and other material displayed on the Application;

    2. screens, organisation, patents and operation or control features; and

    3. all software associated with the Application.

 

  1. The Supplier is the owner of the Application and all Intellectual Property Rights in the Application and all services provided by the Supplier shall vest in the Supplier; nothing in these Terms and Conditions constitutes a transfer of any Intellectual Property Rights. The User acknowledges that the Supplier owns all Intellectual Property Rights in the Application and will not directly or indirectly do anything that would or might invalidate or put in dispute the Supplier’s title in the Application.

 

  1. Subject always to the license at clause (d) below, any digital content that a User submits/uploads to the Application remains the property of that User. Users are solely and entirely responsible for all content that they upload, post, or otherwise transmit via the Application/services and/or to any of the Suppliers social media platforms. The User represents and warrants that any content they submit/upload to the Application and/or any of the Supplier’s social media platforms: (i) will not violate any terms of these Terms and Conditions; (ii) will not be unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, obscene, libelous, invasive of another’s privacy, hateful, discriminatory, harmful to minors, promoting political or religious extremism, or otherwise be reasonably objectionable to any person or entity; and (ii) shall be the property of that User and the User has all necessary rights and permissions required for all content they post and for the rights they grant to the Supplier below.

 

  1. By submitting any content to the Application/service and/or to the Supplier’s social media platforms, you grant the Supplier an irrevocable, worldwide, non-exclusive, royalty-free, fully transferable, and sublicensable right to use, reproduce, adapt, modify, publish, translate, create derivative works from, distribute, and display such content as well as those derivative works on the Application, the Supplier’s website(s), the Supplier’s social media platforms (such as Facebook, Twitter, TikTok, Youtube etc.) , emails and other forms of communication and/or marketing (in any form) sent by the Supplier, for commercial, or promotional purposes. The User agrees that the Supplier has no obligation to monitor or protect any User’s rights in any content that a User may submit/upload pursuant to this clause. The Supplier reserves the right at its absolute discretion to request that a User (or a third party who has taken/used the User’s content) removes their content off the Application/service and/or the Supplier’s website(s) and/or social media platforms and the User shall do so immediately without delay (and/or shall procure that any third party shall do so). 

 

  1. The User shall fully indemnify the Supplier against any loss, costs, expenses, demands or liability, whether direct or indirect, arising out of a claim by a third party against the Supplier alleging that the Application or the Customer’s use of the Application infringes any such Intellectual Property Rights of any person as a result of the User’s breach of these Terms and Conditions.

8. Data Protection 

The Supplier shall, in providing the Application, comply with its Privacy Policy relating to the privacy and security of User’s Personal Data. The Privacy Policy is available at www.geocash.win (or such other website address as may be notified to Users from time to time) as such document may be amended from time to time by the Supplier in its sole discretion.

9. No Warranties

  1. THE APPLICATION IS PROVIDED “AS IS”.  TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SUPPLIER DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, TERMS OR CONDITIONS, EXPRESS OR IMPLIED, WHETHER BY STATUTE, COMMON LAW OR OTHERWISE, REGARDING THE APPLICATION/SERVICES AND THE CONTENT AVAILABLE THROUGH THE APPLICATION/SERVICES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, NON-INFRINGEMENT, MERCHANTABILITY, AVAILABILITY, AND LACK OF NEGLIGENCE. 

 

  1. USERS SHALL ASSUME THE ENTIRE RISK AS TO THEIR USE OF THE APPLICATION/SERVICES AND THE CONTENT AVAILABLE THROUGH THE APPLICATION/SERVICES. USERS ACKNOWLEDGE AND ACCEPT THAT THE SUPPLIER MAKES NO REPRESENTATIONS, PROMISES OR WARRANTIES ABOUT THE APPLICATION/SERVICES OR CONTENT AVAILABLE THROUGH THE APPLICATION/ SERVICES, INCLUDING BUT LIIMITED TO WITH REGARD TO THEIR LACK OF ERRORS OR DEFECTS, AVAILABILITY, RELIABILITY, SECURITY, FUNCTIONALITY, ACCURACY, OR TRUTHFULNESS (WHETHER PROVIDED BY USERS OR THE SUPPLIER), OR LACK OF VIRUSES OR ANY OTHER HARMFUL COMPONENTS. 
     

  2. WHILE THE SUPPLIER TAKES REASONABLE STEPS TO ENSURE THE ACCURACY OF INFORMATION, DATA AND TOOLS PRESENTED IN THE APPLICATION, IT IS NOT RESPONSIBLE FOR THE ACCURACY OF THE SAME PROVIDED IN THE APPLICATION OR FOR ANY DECISIONS THAT THE USERS MAY OR MAY NOT CHOOSE TO TAKE HAVING ACCESSED SUCH INFORMATION.            
     

  3. THE USER ACKNOWLEDGES AND AGREES THAT THE APPLICATION USES THIRD PARTY SERVICES/SYSTEMS, SUCH AS LOCATION SERVICES/GEO-TAGGING AND “PUSH NOTIFICATIONS” WHICH RELY UPON THE OPERATING SYSTEMS OF THIRD PARTIES, SUCH AS GOOGLE, APPLE AND ANDROID FOR DELIVERY AND PERFORMANCE, AND THE SUPPLIER DOES NOT MAKE ANY WARRANTIES, REPRESENTATIONS OR PROMISES ABOUT THE PERFORMANCE, RELIABILITY, ACCURACY, AVAILABILITY, SECURITY OR  OTHERWISE OF SUCH THIRD-PARTY SERVICES/PRODUCTS.      
     

10. Liability

  1. Users acknowledge and accept that they are using the Application in connection with the skill based game(s) within the Application. To the full extent permitted by law, and subject always to clause 10(g) below, the Supplier (and all employees/workers of the Supplier) shall not in any way be liable for any loss (direct or indirect), interruption of business or any consequential or incidental damages (including due to negligence) exemplary, punitive or special damages, lost profits, revenues or data arising from these Terms and Conditions incurred by the User in relation to the User’s use of the Application/the provision of Services.    
     

  2. Subject always to clause 10(g) below, the User agrees that the total aggregate liability of the Supplier (and all employees, officers and workers of the Supplier) is limited to the lesser of: (i) the amount the User paid the Supplier for the Application/use of services in the twelve months preceding any claim; and (ii) the amount of direct damages incurred by the User in reliance on the Application/services. The User acknowledges and accepts that this is their sole and exclusive remedy and the User hereby releases the Supplier and the Supplier’s employees, officers and workers from all liability, obligations, claims, or demands in excess of the limitation of liability set out in this clause.
     

  3. The User shall indemnify the Supplier (and the Supplier’s employees, officers and workers) and keeps them indemnified, in relation to all claims, demands, actions, liabilities, losses, costs, damages and expenses of whatever nature (including legal costs on a full indemnity basis) arising out of or relating to these Terms and Conditions, including (but not limited to) in relation to: (i) the User’s failure to comply with any terms of these Terms and Conditions; (ii) the User’s breach of applicable law; and/or (iii) the User’s fraudulent and/or negligent use of the Application. 

 

  1. The User acknowledges that they are entirely responsible for their actions, decisions, travelling, choices and behaviours at, or on the way to or from, any specific location (whether indoors, outdoors, in village/town/city or in the countryside) during a Treasure Hunt or otherwise whilst using the Application. The User indemnifies the Supplier (and the Supplier’s employees, officers and workers) and keeps them indemnified, in relation to all claims, demands, actions, liabilities, losses, costs, damages and expenses of whatever nature (including legal costs on a full indemnity basis) arising out of or relating to death, personal injury, damage to property, or any other consequence/third party claim as a result of, or relating to, the User’s use of the Application and/or partaking in a Treasure Hunt.  

 

  1. The Supplier is under no obligation to provide upgrades, maintenance support or any other variations to any of the software relating to the Application except where required by applicable law.

 

  1. All Treasure Hunts provided within the Application are created, hosted and run by the Supplier. The relevant App Store (for example, the Apple App Store, Google Play or such other repository of mobile applications made available for download as may be compatible with the Application from time to time) does not sponsor, endorse nor is it in anyway involved in the provision of any Treasure Hunts or other games, sweepstakes or competitions made available via the Application. 

 

  1. Nothing in these Terms and Conditions shall exclude or limit either party’s liability: (i) for death or personal injury caused by its negligence; (ii) for fraud or misrepresentation; or (iii) to the extent that such liability cannot, as a matter of law, be limited or excluded.

11. Force Majeure

  1. Neither party shall have liability to the other under these Terms and Conditions if it is prevented from or hindered or delayed in performing its obligations under these Terms and Conditions, or from carrying on its business, by acts, events, omissions or accidents beyond its reasonable control, including, without limitation, strikes, lock-outs or other industrial disputes (whether involving the workforce of the affected party or any other party), failure of a utility service or transport or telecommunications network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or sub-contractors (“Force Majeure Event”),      
     

  2. Without limitation on clause 11(a), each party acknowledges that the other does not control the App Store or the operator of any App Store and that any act or omission of any App Store operator shall, if it delays, hinders or prevents either party from performing its obligations under these Terms and Conditions be a Force majeure Event.

 

12. Variation

  1. Subject always to clause 12(b), no variation of these Terms and Conditions shall be effective unless it is agreed by the parties in writing.

 

  1. The Supplier may update and amend these Terms and Conditions from time to time without notice.   It is each User’s responsibility to ensure they review these Terms and Conditions regularly to ensure they understand the terms which will apply at that time. By continuing to use the Application after any change to the Terms and Conditions, the User agrees to be bound by the revised Terms and Conditions.  

13. General provisions

  1. Users must not assign or otherwise deal in any other way with any of its rights under these Terms and Conditions without the prior written consent of the Supplier. The Supplier may assign or otherwise deal in any other way with any of its rights under this Agreement (including the license granted to the User) without prior notice to the User.

 

  1. These Terms and Conditions and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.  Each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales over any claim or matter arising under or in connection with these Terms and Conditions (including in respect of non-contractual claims, disputes or other proceedings).

 

  1. If any term of these Terms and Conditions is found by any court or body or authority of competent jurisdiction to be illegal, unlawful, void or unenforceable, such term will be deemed to be severed from these Terms and Conditions and this will not affect the remainder of the Terms and Conditions which will continue in full force and effect. 

 

  1. No person who is not a party to these Terms and Conditions shall have any right pursuant to the them.

 

  1. These Terms and Conditions, along with any guidelines, terms, or policies posted on the Application and/or the Supplier’s website(s) or that are otherwise notified to Users by the Supplier, constitutes the entire agreement between the Supplier and the User with regard to the User’s use of the Application/services.

 

14. Skill-based Games 

All Treasure Hunts/games provide within the Application are skill-based games; the winner(s) of each Treasure Hunt/game is/are not chosen at random, but are governed by things that are within Users' control (such as their skill, speed and determination to solve and win the Treasure Hunt etc). As such, the Supplier does not consider the Treasure Hunts/games provided within the Application as "gambling".
